Democratic Representative Charles Karch introduced a resolution to give Congress power to punish murder and kidnapping. Although states retain primary jurisdiction over these offenses, Congress has exercised its power under the commerce clause to adopt the Lindbergh Act, making it a crime to transport a victim across state or national lines and creating a presumption that such transit has occurred when a victim is not released within 24 hours (Black’s Law Dictionary 1969, 837).
